Human Rights Center "Viasna" specifies: UN Human Rights Committee considered Siarhei Kavalenka's communication to be inadmissible for consideration
It means that the appeal of Vitsebsk activist of the Conservative-Christian Party "Belarusian Popular Front" Siarhei Kavalenka wasn't considered by the UN Human Rights Committee on its merits. The Committee refers it to the absence of sufficient information in the presented materials.
This is stated in the decision on acceptability, issued by the Committee on 31 October 2012. As required by the procedure of consideration, the Human Rights Committee must determine whether the communication is acceptable with the view of the Optional Protocol of the International Covenant on Civil and Political Rights.
What concerns Kavalenka's case, the Committee points that the materials which have been submitted by him are insufficient for establishing the fact of the violations, mentioned by him in his complaint, and that he hasn't substantiated his statements well enough. That's why the Committee decided to deem the complaint of Siarhei Kavalena as inadmissible (according to Artile 2 of the Optional Protocol to ICCPR).
However, it would be incorrect to state that the UN Human Rights Committee denied the violation of Siarhei Kavalenka's rights.
