Mahiliou court issues invalid answers
According
to independent trade union activist Aliaksei Paulouski, the response issued by Mahiliou
Leninski District Court to his appeal is legally invalid, as it has no
registration code and the date of issuance.
Considering
this, the trade union activist submitted a complaint to head of the Chief Department
of Justice of Mahiliou regional executive committee and Chairman of Mahiliou Regional
Court.
In
his statement, in particular, Aliaksei Paulouski asks to cancel the decision by
the Court’s Chair Mrs. Kuzhaleva to deny compensation of overly paid state fees
of 450,000 rubles. He also demands to return the money, and also to instruct
all the employees of the Court of Leninski District
of Mahiliou in order to prevent similar violations in future.
Human
rights defender Barys Bukhel says that the responses issued by government
agencies abound in such mistakes.
"Such
errors are not admissible for government agencies, especially for the Chairman
of a court. Similar mistakes were made by the KGB in the case of civil activist
Aleh Aksionau. One
of the papers in the case was signed by an unknown deputy of Head of the Mahiliou
KGB. Later, they sent the required documents to court in a cover letter without
a registration number. All
this is evidence that officials do not respect the law,” says Barys Bukhel.
According
to the human rights defender, such documents are not legally binding, and the
courts have no right to refer to them.
