Barysau: Activist Mikhail Kandrashou Is Fined for Activity on Behalf of Unregistered Organization

On 12 September 2006 in Barysau the police searched the apartment of a youth activist Mikhail Kandrashou connected with a check-up concerning his relation to an unregistered resistance movement For Freedom!. The police confiscated from him information carriers, paper documents, correspondence with foreigners, printed texts by Occasional President Pavel Sharamet, What a participant of political action needs to knowё etc.

On the basis of the confiscated materials on 13 December 2006 the police passed to Barysau district prosecutor’s office materials on bringing against M.Kandrashou a criminal case under article #368 of the Criminal Code – insult of the president of the Republic of Belarus.

On 15 December a senior investigator of the prosecutor’s office A.Valasian reported about absence of corpus delicti provided by article 368 of the Criminal Code in Kandrashou’s actions and ruled to refuse in bringing a criminal case. On the other hand, he pointed, activity on behalf of unregistered organization is an administrative violation under article 167-10 of the Administrative Code. That’s why on 13 January 2007 senior justice counselor, prosecutor of Barysau district V.Shpakouski brought an administrative case against Mikhail Kandrashou. As a result, on 13 January Mr. Kandrashou was detained and taken to Brest city prosecutor’s office and then – to court. Despite the fact that Saturday is a day off for Belarusian courts judge Iu. Kobets considered the administrative case and ruled to fine the activist about 145 US dollars.
