Homel activist Andrei Aksionau disputes fine

The activist was fined for distributing printed media without date-line (part 3, article 172 of the Administrative Code) after the police confiscated one leaflet with information about the 20th anniversary of Chernobyl disaster.
Mr. Aksionau filed a complaint to Homel Chyhunachny Borough Court, but in vain. Another complaint was sent to Homel Regional Court. Yet, the court found no reasons for overrunning the verdict.
Leanid Sudalenka, head of Pravavaia Initsyiatyva Homel City branch, comments on the situation: In such cases, when administrative commissions and courts impose fines, they are ruled by Part 1 of Article 26 of the Law of the Press and Other Media. However, the article explains the requirements for periodicals data-lines, while leaflets are not periodical editions and are not regulated by this article. So the aim of Aksionaus complaints is to show this difference.
A.Aksionau is going to draw up a third complaint for the consideration of the Regional Courts chair.
