Homel regional court doesn’t know the law

The Homel regional court refused to consider the complaint lodged by Uladzimir Tseliapun, a member of the Belarusian Popular Front Party, against the non-registration of his candidacy, referring to Article 246, part 1 of the Civil Process Code.

The judge explains the refusal by referring to Article 68 of the Election Code, according to which regional courts can consider appeals against decisions of regional elections commissions concerning complaints against decisions of district territorial election commissions and constituency commissions on denial of registration of candidacies for regional Councils of Deputies.

However, Uladzimir Tseliapun appeals against the decision of the Homel regional election committee that left standing the decision of the Mazyr district election commissions according to which he was denied registration as a candidate for the district Council of Deputies.

This situation witnesses the elementary illiteracy of the judge of the Homel regional court who stated that consideration of such cases was outside the competence of the court.
